Commitment 5:

Comprehensive sick leave policies

Employers commit to recognizing mental health needs within workplace sick leave and wellness policies.  

Employer Actions

Organizations should develop leave policies that support both physical and mental health needs. To fulfill this commitment, organizations are encouraged to: 

  • Align workplace leave policies with New Brunswick Employment Standards, which provide employees with five unpaid sick days after 90 days of service 

  • Recognize mental health needs as legitimate reasons for using sick leave 

  • Consider wellness bank models that support both physical and mental health needs 

  • Communicate clearly how employees may access health-related leave 

  • Protect employee privacy by limiting unnecessary disclosure of personal medical information 

  • Apply medical documentation requirements consistently and in accordance with employment standards 

Evidence Requirements

To complete this commitment, organizations are asked to: 

  • Review or develop workplace leave policies that support both physical and mental health needs  

  • Implement at least two practices that support accessible and inclusive sick leave processes, such as:  

  • recognizing mental health needs as valid reasons for sick leave  

  • communicating leave processes and entitlements clearly to employees  

  • protecting employee privacy during leave or accommodation discussions  

  • reviewing medical documentation practices to reduce unnecessary barriers  

  • exploring wellness bank or flexible leave approaches where appropriate  

  • Submit a short reflection describing actions taken and future opportunities for improvement  

Evidence may include: 

  • Sick leave or wellness policy documents  

  • Internal communication or employee guidance materials  

  • Leave request procedures or forms  

  • Training materials or meeting notes  

  • Reflection summary 

Impact

Recognizing mental health as part of sick leave supports employee well-being and productivity by allowing time to manage stress, burnout, or other mental health needs. Inclusive leave policies normalize seeking support, reduce stigma, and foster a healthier workplace culture. This commitment ensures employees can take needed time off without barriers, promoting a workplace that values health and overall well-being.

  • Sample leave policy wording: “[Organization Name] recognizes that mental health is as important as physical health. Employees may use sick leave for mental health needs, including stress, burnout, or recovery time. Privacy is respected, and disclosure of a diagnosis is not required. A medical note may be requested only for absences of four or more consecutive days in accordance with New Brunswick Employment Standards.”
